Privacy and Data Protection Policy

INJURY & CLAIM

1. Introduction and Scope

Injury & Claim is committed to protecting your personal information. This Policy explains how we collect, use, disclose, store, transfer, and otherwise process personal information when you use our website, online platform, and related services (the “Platform”), including claim forms, accounts, communications, and documents submitted in connection with a claim.

It applies whether information is submitted by you or, where legally permitted, by an authorized representative. Where local law gives you greater protection or additional rights, local law prevails to the extent required.

2. Information We Collect

  • Identity and contact: name, date of birth, gender where relevant, address, email, telephone, identification details, and account credentials.
  • Claim and incident: incident details, photographs and videos, witness and insurer/employer information, police or incident reports, supporting documents, and compensation information.
  • Health and medical: injuries, illnesses, medical history, diagnoses, reports, treatment, medical bills and disability information. This may be sensitive or special-category information and is subject to additional safeguards.
  • Technical and usage: IP address, device and browser details, approximate location, logs, pages accessed, and cookie data.
  • Third-party sources: where legally permitted, insurers, employers, healthcare providers, legal practitioners, claims handlers, investigators, witnesses, regulators and authorised representatives.

3. How We Use Personal Information

We use personal information to:

  • create and manage accounts
  • receive, assess, verify, investigate and manage claims, and communicate with you and relevant parties about them
  • connect you with legal, medical, insurance or other professional services where applicable
  • prevent fraud and unlawful activity, and protect the security of the Platform
  • comply with legal and regulatory obligations, and establish, exercise or defend legal claims
  • improve our services, conduct audits and analytics, and keep business records
  • respond to enquiries and complaints, and send service communications and, where permitted, marketing.

We will not use personal information for incompatible purposes unless permitted or required by law.

4. Lawful Bases

We do not rely solely on consent. Depending on the jurisdiction and circumstances, we process personal information on one or more of these bases: consent; performance of a contract; legal obligation; establishing, exercising or defending legal claims; protection of vital interests; legitimate interests (where not overridden by your rights); public interest; or another basis recognised by applicable law.

5. Consent

Where consent is required, we will obtain it electronically through a legally valid mechanism, such as an unticked checkbox, a clear “I Agree” or “Submit” action, account settings, or confirmation by email. We will meet any standard the law requires.

Use of the Platform alone is not consent where the law requires separate affirmative consent. You may withdraw consent at any time where consent is the lawful basis, without affecting prior processing.

6. Sensitive Information

Sensitive information (including health data, biometric data and information about sexual offences or harassment) is processed only where we have a lawful basis and any additional condition the law requires, such as explicit consent, legal claims, vital interests, healthcare purposes, or legal authorisation. Acceptance of this Policy does not by itself constitute explicit consent for every category of sensitive information.

7. Information About Other People

Provide information about another person (including a child, dependent, witness or patient) only if you are authorised to do so. Where legally required, we may take reasonable steps to verify that authority.

8. Disclosure and Service Providers

Where reasonably necessary and legally permitted, we disclose personal information to: insurers and intermediaries; employers; lawyers; medical professionals and assessors; claims handlers, loss adjusters and investigators; experts and advisers; courts, regulators and public authorities; payment, technology, cloud, security and fraud-prevention providers; authorised representatives; and other providers needed to operate the Platform.

Service providers process information on our behalf under contractual, technical and organisational safeguards where the law requires. We seek to ensure all recipients handle personal information lawfully and confidentially.

9. Security and Breaches

We use reasonable technical, organisational and administrative measures, such as access controls, authentication, encryption where appropriate, and monitoring, to protect personal information. No online system is completely secure. You are responsible for keeping your credentials confidential and must notify us promptly of any suspected compromise.

If a personal data breach occurs, we will assess it and notify regulators and affected individuals within the period and in the manner required by law.

10. Retention

We keep personal information only as long as reasonably necessary to provide services, resolve claims, meet legal and regulatory obligations, address disputes, prevent fraud, keep business records and enforce rights. Retention periods vary by information type, claim and applicable limitation periods. When information is no longer needed, we will securely delete, destroy or anonymise it.

11. Children and Minors

The Platform is not intended to unlawfully collect children’s information. Where a claim involves a minor, we process their information only where permitted or required by law and with appropriate safeguards. We may require consent or authorisation from a parent, guardian or other authorised representative, applying the age threshold set by the relevant law.

12. Accuracy and Minimisation

We collect only information reasonably necessary for the purposes in this Policy. Please provide accurate, complete and current information and tell us if it changes.

13. Legal Disclosures and Confidentiality

We may process or disclose personal information where reasonably necessary to establish, exercise or defend legal rights; respond to legal proceedings or lawful demands; comply with regulatory requirements; investigate fraud or unlawful conduct; or protect the rights, safety or property of Injury & Claim, our users or others. Where permitted, we limit disclosure to what is relevant and necessary.

We recognise that claims involve highly personal information. We restrict access to those with a legitimate business, legal, professional or operational need, and seek appropriate confidentiality protections from advisers and service providers.

14. Applicable Law

Depending on your location, where data is collected, where services are provided and where providers are based, more than one privacy law may apply. This Policy should be read with any jurisdiction-specific notice we provide. Where a mandatory local legal requirement conflicts with this Policy, the legal requirement prevails to the extent of the conflict.

15. Changes to This Policy

We may update this Policy to reflect changes in our services, technology, law or practices. We will notify you of material changes through the Platform, email or another appropriate method. The updated Policy will state its effective date.

16. Contact

For questions or requests about this Policy or your personal information, contact us using the privacy contact details on the Platform. You may also contact your local data protection or privacy regulator.

17. Acknowledgement

By using the Platform, submitting information or creating an account, you acknowledge that you have had the opportunity to review this Policy. Where the law requires consent for a particular activity, we will obtain it separately through an affirmative mechanism, and separately, specifically or explicitly where required. Nothing in this Policy removes or waives any mandatory privacy right available to you under applicable law.
